O2 visa is given for assistants and personnel of O1 visa holders

O2 visa

All individuals who obtain O-1 visa are very talented in their specific field and U.S institutions recognize that those who hold an O-1 visa requires them to hire additional people who play an important role in their success. Their personnel and assistants are highly valuable and need to accompany them when they travel by obtaining O-2 visa.
Individuals with O-1 visas in science, education or business are not permitted to bringing their staff with them. O-2 visa is for individuals who work in TV, film, and athletics are allowed to bring their personnel.
The sponsor of O-1 visa holder must sponsor both the O-1 person as well as the staff with an O-2 visa.
O-2 visa holders are also allowed to enroll in part time study in the U.S Besides working for the O-1 visa holder and assisting them.

Eligibility criteria for assistant of the O-1 visa holder
  • The applicant must be a critical member of the performance or work of the O-1 visa holder and have the skills and experience which the O-1 visa holder’s performance or work requires, which cannot be found in other workers
  • The applicant must only work with people who have a valid O-1 visa and not in other jobs, even if they are related to the skills and experience of O1
  • Proof of documents that prove that the intention is to only work in the U.S and the applicant has residence in another country, and have ties to the home country

Step by step application process for O2 visa

The sponsor in U.S has to begin the application process, and then the applicant can file their application at a U.S Embassy in the home country.
  1. Filing Form I-129
  2. Complete form DS-160
  3. Pay the O2 visa application fee
  4. Submit your O2 visa documents
  5. Attend your interview
STEP 1: Filing Form I-129

The U.S sponsor must file a petition to USCIS to get permission for O-2 visa holder can work in the U.S and assist the O-1 person with their work by filling Form I-129
USCIS validates all documents submitted and if approves the petition, they will issue Form I-797 to the employer which will help the applicant to apply for the visa in their home country.

Documents need be submitted by the Sponsor

Opinion Letter - An opinion letter from a certified labor organization or management statement saying that the skills and experience the O2 applicant holds are so critical to the O-1 visa holder’s work that there are no available U.S employees who can be replaced with them.
Contract Document - A copy of the contract between the sponsor and the O-1 visa holder. A written contract is widely accepted, but they can also be oral, only a summary of the main points needs to be submitted. The contract should describe the work the U.S sponsor will be doing with the O-1 visa holder with the dates of the work, any events etc.

STEP 2: Complete form DS-160
  • Complete Form DS-160 -form
  • After successfully completing the application, you will receive a confirmation number a 10-digit number. This confirmation number is required for setting up of visa interview appointment. Set up the visa interview
STEP 3: Pay fees
  • Fee for filing the petition this fee is determined by USCIS and varies year by year.
  • Other fees associated with petitioning.
  • Visa application fee-$190
  • Visa issuance fees may apply depending on the relationship of your country and the U.S
US IR-2 application
STEP 4: Documents by the applicant for O2 visa
  • Receipt of form DS-160
  • Approval documents of forms I-129 and I-797 by USCIS
  • A copy of current passport with all pages and any previous passports available
  • Receipts of payments made for all applicable visa fees
  • To complete the form, the applicant needs a photo in the acceptable format Photo Requirements
  • Contract document with the O-1 visa holder and previous contracts with them
  • Proof of skills and experience related to the work of the O-1 visa holder
  • Proof of relationship if the applicant is getting the family along
  • Proof that you have strong ties to your home country and you intend to return once your contract and visa expire. This could be a property deed or apartment lease.
STEP 5: Attend interview

All applicants must attend an interview at the US Embassy or Consulate in their home country where they are applying. The necessary checks on all documents will be made and interview will be scheduled by NVC
