E2 Visa for treaty investor
E2 visa a US nonimmigrant visa is a Treaty Trader and Investor Visa for issued for individual investors or investing companies from countries which have a treaty with the US for further investments.
For an applicant to be eligible for a E2 visa, the investment should be of an amount between $100,000 to $200,000 in an existing business or in a new business, and an increase employment of at least for 3 to 4 people.
To apply for the E2 visa the applicant must be:
- If an employee is sent by the company with E2 visa the employee must be a national of a treaty investment country, with the work position like manager, executive, or specialized knowledge position.
- The applicant who is an individual investor must be must be the national of a country which has an investment treaty with the US.
- Investor (individual or company) must have the intent to invest a generous amount of capital in an existing or new business. Which produces products or services and is profitable.
- Investor (individual or company) must ensure that the business generates more profit than to just make a living. With a goal to develop the business further through that investment.
- Investor must have the intention of returning to their home country once their work is completed.
USCIS will validate all documents and if approved, the entry into the US will depend on the immigration officials at the port of entry.
Visa application process can be done either within US or outside US depending on the situation:
1. From within the US through USCIS
- If the applicant is engaged directly in international trade then the applicant must file Form I-129, Petition for a Nonimmigrant Worker. If the applicant will be working for someone who is engaged in international trade as a supervisor or manager then the company must file a petition Form I-129Form I-129
.
- The applicant must also submit receipts of the fees paid, documents to prove trade relationship, and intent to return to your home country.
- USCIS will validate all documents and if the visa is granted USCIS will give the applicant or the employer a Form I-797, Approval Notice.
Outside the US
The applicant must apply through US Embassy in their country.
