The IR-3 visa is a visa for a adopted child from foreign country by the US citizens. This visa allows the child to come live in the U.S with the adopted parents, attend school, continue into higher education studies, work and obtain U.S citizenship when eligible.
U.S citizens who want to adopt children from other foreign countries and bring them to the U.S to live together as a family. The U.S citizens must complete adoption procedure in the child’s home country; then apply for a US visa.
U.S government has recognized two types of adoption. These depend on the country from where the child was adopted. The application procedures change depending on whether the U.S citizen adopts the child from a Hague Convention Country or from a Non-Hague Convention Country.

Eligibility for IR3 visa

  • Adopting from any other countries than those mentioned in Hague Convention rules means other regulations and application procedures will apply.
  • If a US citizen is planning to adopt a child from a foreign country he must be a U.S citizen with the valid U.S address and be willing to adopt the child and pass an eligibility test by the U.S Citizenship and Immigration Services (USCIS).
  • The adopted child must reside with them past the adoption. The child needs be under 21 years old and be eligible based on the U.S Immigration and Nationality Act (INA).The adopted child must be from either a Hague or Non-Hague Convention Country.
  • If the U.S citizen has already adopted the child and has resided with them in a foreign country for at least 2 years then the child is eligible for an IR-2 visa and does not need to go through the IR-3 visa application process.

IR-3 visa application process for Hague Country Convention Application Procedures

  • US Citizen should choose one of the preferred adoption service providers which is U.S approved adoption country to ensure that all rules and regulations are followed and the adoption provider is also within applicable laws and regulations
  • US citizen must file Form I-800A, to determine the suitability to adopt a child from a Convention Country to USCIS.
  • To file form I- 800A US citizen must complete a background check, fingerprint check, as well as a home study. Then USCIS will determine the age range and number of children you are allowed to adopt if approved.
  • US citizen will then apply to adopt .The authorities of the adoption country will review the documents and approval from USCIS and find an eligible child which you can adopt.
  • US citizen should check all the require documents to be submitted for adoption as each hague country might have different requirements. When the authorities of your preferred hague convention country have found children, which meet the eligibility criteria, they will send referral documents to you. The documents will contain the background of the child, family history, medical history, as well as any other special needs. The file will also have the signed consent by the necessary parties (adoption center, biological parents’ consent, etc.).
  • U.S citizen should file a petition to USCIS by filing Form I-800 to ensure that the child is eligible for immigration. If USCIS approves your petition, then you may move on to the next step.
  • Submit Form DS-260, Online Immigrant Visa Applicationwhich will have information about the child’s background and other details to the U.S Embassy or Consulate of the country in which you are adopting the child.
  • Complete Form DS-160 -form
  • After successfully completing the application, you will receive a confirmation number a 10-digit number.
  • This confirmation number is required for setting up of visa interview appointment.
  • To complete the form the applicant needs a photo in the acceptable format .Photo Requirements
  • U.S Embassy or Consulate in the country in which US citizen is adopting will issue a letter called Article 5/17 Letter which establishes that the child is eligible to immigrate in the U.S. Only after receiving this letter can you obtain an adoption.
  • Submit the all the supporting documents of the child like child’s birth certificate and passport. And schedule an appointment for an interview at the U.S Embassy and attend the interview.

IR-3 visa application process for Non-Hague Convention Application Procedures

  • U.S citizen who wishes to adopt need to choose a adoption center in the country he/she wishes to adopt the child.
  • U.S citizen should file a petition Form I-600A to USCIS to determine that you can be an adoptive parent. USCIS will do a background check, and also study home to determine the eligibility to adopt a child.
  • US citizen should complete all the formalities and obtain an adoption order from the authorities of the country in which they are adopting the child.
  • Once the adoption order is received file Form I-600, Petition to make the adopted child as an Immediate Relative with child’s birth certificate or written explanation about the identity and age of the child, Proof that the child does not have parents or biological parents are unable to provide proper care hence are giving up their child for adoption to USCIS to get approval on child’s eligibility for immigration under U.S law.
  • Consular Officer in the country you are adopting the child from will complete Form I-604 and process for approval. If approved, the National Visa Center (NVC) will notify you with instructions, case number and invoice ID number from NVC which is used to start the application process at the US Embassy or Consulate in applicant’s home country and all the instructions on what to do next and information required.
  • The representative of the child should file and submit IR-3 visa application by filing Form DS-260 Immigrant Visa Application and schedule for the visa interview. Provide complete documents of the child’s adoption at the interview.
